2009/48/EC公布好久了，大家有看到关于它里面玩具定义修改后的guideline吗，大家都认为玩具定义修改后范围扩大了，到底扩大到什么范围呢，2009/48/EC的解释里面讲的也很模糊，现引用解释如下：
b6 F# F" [- BThis Directive shall apply to products designed or intended, whether or not exclusively,3 Y6 J. y6 {7 v! F( W. H$ o
for use in play by children under 14 years of age (hereinafter referred to as "toys").! ~# I. a9 j0 D6 j& i7 m
Article 2 (1) defines the scope of the Directive, that is the products to which it applies.
" l ` _8 Z+ z F9 ^The definition in article 2 (1), first subparagraph, provides the following criteria for4 X D- G: o) [
deciding whether a product falls under the scope of the Directive:0 {' W7 n$ w- Y$ y
Any product or material designed or intended3 j, T+ }0 Y1 U2 }" k' c8 d+ E
whether or not exclusively

The wording of this provision is slightly different than the definition in the 88/378/EEC
3 x! Z4 _0 s4 g* T% @+ ^: jDirective. However, the intention has only been to codify the practise under that
{! c" f% s; rDirective, and not to change the material scope of the Directive from what it has been up
4 d1 e( N r2 L# t5 l! d6 u) B, Vtill now. The words “whether or not exclusively” have been added to the definition to5 ^- n5 {7 C5 t9 p
indicate that the product does not have to be exclusively intended for playing purposes in
2 O8 n/ P7 B+ E0 |; p: t# P1 W& Uorder for it to be considered as a toy, but it can have other functions as well. For% X4 d/ @% s& c
example, a key-ring with a teddy bear attached to it is considered as a toy, or a sleeping+ E" n) W; i# g
bag in the shape of a soft filled toy. It was not the intention to imply that the standard for, a8 T2 f, i5 W( S% D
trampolines for instance needs to take into account adults using the toy-trampoline. Other# h3 F* e) }" s/ c1 P4 @& b
examples of products with double function (door decorations, soft filled animal shaped
! ?+ a9 q z1 m4 ~. X9 }- v# L+ L$ Zpurses or backpacks,…) can be found in guidance document 11 on classification of toys
% x! \0 P% c4 U7 l$ aintended for children above or under 36 months.
