The revision shall replace the current 20 years old toy safety directive that does not adequately # P) V) {- S/ E- C" xdeal with the risks and dangers of newly toy designs. ( N7 J0 g9 X. z I" Y: l: T! ~' mProvisions have been laid down for obligation of manufacturers, importers and retailers of toys,# E% K6 R. X. O9 r" K
while the essential safety requirements of toys have much more related to the chemical properties " T: P8 d! Q0 ]: ]4 ]0 j* [8 Pand labeling of toys. 7 }. U" A4 q: N+ n4 d! R! P) L% sObligation of toy manufacturers: 8 O- L2 a" Y2 G8 a8 ^a. To ensure their toys have been designed and manufactured 7 v+ d- o4 Q& `$ K0 Fin accordance with the essential safety requirements; - H0 C t4 o; A5 T6 Xb. To draw up a complete product file for each toy and to carry" j* p) o8 Y0 H/ J. l( X
out conformity assessment prior to marketing of toy; % Q4 F' Z+ U9 e9 y# Tc. To draw up an EC declaration of conformity based on the $ R' a, T+ }8 L1 ^ Zassessment procedure and affix the CE marking; : `% x8 i5 X$ [$ ]5 L5 Q+ Vd. To have unique identification by type, batch or serial or model number or any other- J0 V/ z( t" C2 m, ?9 P
element on the toy or packaging or document accompany the toy;, f( O- `- V, N
e. To accompany toy by appropriate safety warnings and instructions in a language or$ P2 e4 l1 F/ l9 `5 k1 u
languages easily understood by consumers; : Q4 Z. W7 b# z3 Z8 r: F' mf. To keep the technical documentation and the EC declaration of conformity for a period of& Y+ t% Q5 v$ \
ten years after a toy has been placed on the EU market (This also applies to the: U2 s7 K8 r7 g: u3 X
authorized representatives and importers of toys);8 G1 H! G1 Q2 U6 C E2 E) R; R
g. To indicate their name, registered trade name/mark and address on the toy or packaging or5 d9 k; q. w: b. v# [3 V
document accompanying the toy (This also applies to the authorized representatives and & Z n, G7 g+ M5 w0 N" Vimporters of toys).% E9 A+ y$ n: s. G
Essential safety requirements of toys have been amended with following additions:8 K* W8 w: E3 n1 I0 Z4 g9 E, u
a. Where appropriate, toys shall bear warning label that specify appropriate user limitation. 8 J5 b$ m: r: EHowever, warnings that contradict the intended use of the toy are prohibited, e.g. label3 ]1 G% c2 E# r* n4 z2 ?% G& {0 f

Toys attached to a food product that must be consumed in order to get direct access to the 0 ^4 X2 C5 f% l4 y# K3 d& R) @, `toy shall be prohibited, whereas toys contained within food or mixed with a food product % r1 d6 c* ]3 Imust have their own packaging; : g& O% {) n/ r+ W1 Md. Substances that are classified as carcinogenic, mutagenic or toxic for reproduction, N$ J) w" S& E) p

e. Nitrosamines and nitrosable substances are prohibited for use in toys intended for0 |+ z7 d2 X5 M% x9 F0 U4 q/ V+ x

Directive 76/768/EEC; $ v) B' j# _+ t9 |) jg. Toys shall not contain specific allergenic fragrances unless it is not avoidable in good2 p2 e; z! l( h
manufacturing practice and does not exceed 100ppm; . A# A8 U( Z) ~: Y& b, Vh. Migration of following metals from toys or toy components accessible to children, when & Y/ C) e.
